The U.S. Supreme Court has held that an increase in the penalty for a crime beyond the statutory maximum must be based on facts submitted to a jury and proved beyond a reasonable doubt. Apprendi struck down a New Jersey statute authorizing judges to increase maximum sentence based on facts judge found to be true by a preponderance of the evidence, but not proof beyond a reasonable doubt and affirmed judge's authority to increase maximum based on prior convictions, or crimes defendants confess to, without jury finding.
