There are a variety of ways or mechanisms available to secure bail depending on the jurisdiction, the crime, and the defendant. Full cash bail is when the defendant pays the full bail amount out of pocket. In some jurisdictions, property can be pledged instead of cash. Deposit bail is when the defendant deposits a percentage of the bail amount, typically 10 percent, with the court. When the defendant appears in the court, the deposit is returned, and if they fail to appear, they are liable for the full amount. Surety bail is similar to deposit bail except instead of paying the percentage of the bond to the court, the defendant pays it to a bonding agent who posts the full bail. The bonding agent is liable for the full amount of the bond should the defendant fail to appear, and they usually require posting collateral to cover the full amount. Surety bail is the most common form of bail. Conditional bail is when the defendant is released after promising to obey some specified conditions in lieu of cash, like attending a treatment program. Unsecured bond is when the defendant is released with no immediate requirement of payment but may be liable if they fail to appear in court. Finally, release on recognizance is when eligible defendants are released without bail upon their promise to return for trial. Multiple studies have been done in an attempt to determine which form of bail is the most effective with some mixed results. A study by the University of Texas at Dallas found that surety bail was the most effective, while another study suggested property bail (posting property value that is forfeited with failure to show) is.
