What are the three main elements included in the presentence report (PSR)?
What will be an ideal response?
The first part of the PSR enumerates the facts of the case based on both the police report and the defendant's version of what happened. As you might expect, the police and defendant's versions often conflict. Judges tend to accept the police version.
The second part of the PSR includes the offender's prior criminal record, including prior convictions, dropped charges, and arrests. Social histories include family history, employment record, and education. Judges say social histories help them predict the offender's potential for rehabilitation and future behavior. Psychiatric evaluations include the defendant's history of mental illness, hospitalizations, treatment, and recommendations.
The impact of the crime on the victim is typically included in the PSR to help the judge understand the true nature of the crime committed.
