As people both inside and outside policing are increasingly exposed to computer evidence, there is an increased risk of legal liability. Agencies that cause damage to computer records through negligence, causing negative financial consequences to the owners of those records, may be liable under Section 1983. Liability under the Privacy Protection Act may also result, depending on the contents of a seized computer.
