The law requires that each educational system "take appropriate action to overcome language barriers that impede equal participation by its students in its instructional programs." "Appropriate action" does not mean that schools must provide instruction in a student's primary language nor does the law specify any other specific methods. For the most part, "appropriate action" has been guided by three principles arising from another federal law decision (Casteneda v. Pickard, 5th cir. 1981):
1) Use sound theory. Some experts must view the educational theory forming the base for instruction as sound.
2) Provide adequate support. The school system is obligated to provide resources, procedures, and personnel to implement effectively the theory's practice in classrooms.
3) Achieve results. The program's implementation must result in students actually overcoming English language barriers to equal participation in a school's instructional programs. The program should not result in students revealing academic deficits.
