When working in the legal department of a corporation, what steps should the paralegal take, upon discovering illegal behavior, to protect the client as well as the paralegal’s employment?
What will be an ideal response?
In order to protect the client, who is the corporation, the legal assistant must follow the chain of command in reporting the information, by reporting it to the corporate counsel. If the corporate counsel is the one committing the illegal conduct, the legal assistant then must follow the corporate chain of command. In order to protect the legal assistant’s employment, the legal assistant cannot be a whistle-blower, because the duty of confidentiality applies to the legal assistant, unlike to the other nonlawyer corporate employees.
