• Infanticide is the killing of an infant close to or at the time of birth. Statutes and definitions vary regarding when a child is "born" and a viable human being. Some define it as the beginning of the birth process, while other jurisdictions define life as the taking the first breath. To be infanticide, the homicide must involve a victim defined as a "human being."
• Feticide is the killing of a fetus that has yet to be considered a "human being" by the applicable definition. The statutes regulating feticide generally fall into three categories: (a) the killing of an unborn child in a pregnant woman; (b) the killing of an unborn child in a woman with a quick child; or (c) killing an unborn vitalized embryo or fetus. The trend is to criminalize the killing of any fetus or unborn child, regardless of the stage of gestation or development.
