Describe the pros and cons of plea bargaining.

Examples should indicate that plea bargains reduce the number of cases that go to trial, which reduces costs and allocates resources to other cases. Plea bargaining allows defendants to avoid trial and a potentially more serious sentence if they are found guilty. This may allow criminals to get away with a light sentence, but it also may coerce innocent persons to take a plea to avoid the risk of a more serious sentence. Plea bargaining also undermines constitutional rights, since the defendant is waiving his or her right to a jury trial, the right to confront witnesses, the right to require the prosecution to prove their case, the right to challenge any evidentiary matters, and the right to appeal the facts of the case.
