Does the Court set guidelines for what are permissible and impermissible affirmative action plans?
The Court chose not to define in detail the line of demarcation between permissible and impermissible affirmative action plans. It did set forth certain guidelines for permissible affirmative action plans:
(a) The plan must be remedial to open opportunities in occupations tradition¬ally closed to blacks; that is, there must be a conspicuous racial imbalance, and the plan must be directed at rectifying the matter.
(b) The plan must not unnecessarily trammel the interests of white employees.
(c) The plan must be voluntary.
(d) The plan must be temporary.
