Nonunion employers are able to make unilateral changes to the wages, hours, and working conditions of their employees at any time unless they are bound by the terms of an individual employment contract. Unionized employers must negotiate wages, hours, and working conditions with the union and therefore are not allowed to make unilateral changes unless the parties have bargained to impasse. If the current contract has expired and the employer and union have negotiated to impasse, the employer has fulfilled its obligation to bargaining and is then allowed to make unilateral changes to the contract. These unilateral changes would be allowed until such time as a new contract is reached.
