The increased involvement in private prisons raises legal issues. One of the major legal issues is whether private correctional officers have less immunity from lawsuits than state employees. In Richardson v. McKnight, the Supreme Court held that correctional officers employed by a private firm are not entitled to qualified immunity from suits filed by prisoners. In Correctional Services Corp v. Malesko, the Supreme Court ruled that although a prisoner can sue an employee of the private correctional corporation for violating his constitutional rights, he could not sue the correctional corporation itself.
