Since the early 1990s, efforts have been under way in a number of states to reform a number of
aspects of the jury system. In this period, 38 states have created statewide commissions to consider ways
of improving the jury system. These commissions have made various recommendations to state policy
makers, resulting in a myriad of reforms. The reforms can be placed into two general categories: jury
management and trial practices. A central theme among the trial practices reforms has been to make
changes that enhance the ability of jurors to accurately consider the evidence presented to them and apply
it to the law. Reforms to the jury system include: allowing jurors to take notes, allowing jurors to question
witnesses, providing written copies of instructions for each juror, and providing jurors with a trial
notebook.
