• There are many problems with this system of bail as a requirement for release. First, the availability of financial resources and the ability to "make bail" are not related to the risk of the offender or the chance of successful criminal processing. Second, the bail process discriminates against the poor. Those unable to afford bail or the bond agent's fee usually end up staying in jail not due to risk, but only because they could not afford bail or even the bond agent's fee. Finally, many find the idea that "freedom can be bought for a price" unfair and antithetical to our system of justice for all.
