Explain the meaning of the term "enter" as it applies to the law of burglary of a building or habitation
What will be an ideal response?
A required element of the offense of burglary is that the offender enter the building or habitation. The statute defines "enter" to include any part of the body or any physical object attached to the body. Thus, a hand or arm reaching through a window is sufficient as would be extending a pole or fishing line into the structure. Texas courts have ruled that breaking a lock and hasp as well as merely intruding across the plane of a door, window, or the like is sufficient to constitute entering the structure. It is important to note that force is not an element that must be established in a burglary case, only entry.
