Through an IP audit, a company discovers that five copyright and three trademark registrations it acquired last year when the company merged another company into it remain in the name of the acquired company. What should the company do? Why??
What will be an ideal response?
The company should correct the records of the USPTO and Copyright Office by filing the appropriate documents (likely, by recording assignments or the merger/purchase agreements). Then the records will reflect the true owner so that the true owner can take action with regard to these assets (for example, correcting the chain of title at the USPTO so that the true owner can maintain/renew the registrations) and will be notified with regard to any matters relating to these IP assets.?
