Navigable waters are defined as all "waters of the United States which are used in interstate commerce," including "all freshwater wetlands that are adjacent to all other covered waterways." The U.S. Supreme Court has ruled that the term does not include ponds that are not adjacent to open water. The Supreme Court reasoned that the term "navigable" in the statute reflected Congress's intention to limit application of the Clean Water Act to waters that are or had been navigable in fact or that could reasonably be made so. Permitting federal jurisdiction over ponds and mudflats would impinge on the states' traditional power over land and water use.
