Students should define testimonial evidence as the type of evidence presented in court through witnesses speaking under oath. An example of testimonial evidence is hearsay. Though hearsay is generally not admitted into court, there are common exceptions to this rule. Real evidence should be defined by the student as tangible evidence that is produced as a direct result of the crime being committed. Examples of real evidence include blood spatter, semen, or a knife. Students should define demonstrative evidence as tangible evidence that relates to the crime or perpetrator that is produced indirectly from the crime, such as photographs of a victim's injuries, diagrams, or medical records. Lastly, documentary evidence should be defined by students as any evidence that is in the form of a document or documents a crime-related issue. Examples of this type of evidence include printed e-mails of relevance, bank statements, and surveillance video.
