The application of the Transmit Clause to new technology is at the heart of the Supreme Court’s 2014 decision in American Broadcasting Companies Inc. v. Aereo Inc. At issue was whether Aereo’s innovative system of utilizing thousands of dime-sized antennas to offer its subscribers broadcast television content over the internet violated the Transmit Clause and constituted a public performance of copyrighted works. The Court held that it did, comparing Aereo’s service to a cable system. The Court said its holding was limited to Aereo and its specific technology.
