Docketing within a law office can be as modern as case management and docketing control software or as archaic as a calendar and ball point pen. No matter what the method of date-keeping, it is paramount to avoid malpractice, to stay on top of appearance, due, and filing dates. When paralegals become aware of court dates, it will be noted on the master calendar, and all of the attorney's calendaring technology must be updated. That includes personal calendaring devices, smartphones, online calendars, etc. The paralegal must check the dates for possible conflicts the attorney may have. Depending on who is bringing the motion, her office or opposing counsel, a decision will be made by the moving counsel to go forward with the motion. The motion must be filed, and that may be electronically in some jurisdictions. If the motion is a go, the paralegal should contact the client of the date, if the client is needed to appear at the motion hearing. Prior to the hearing date, the paralegal should locate the file and make sure that all recently received documents and correspondence are appropriately filed. The file should be reviewed and made assessable for counsel's review before the hearing.
