The Wagner Act was the most pro-union piece of legislation in our country’s history. Not only did it establish the right of employees to organize and participate in collective bargaining, but it also established the National Labor Relations Board. The purpose of the NLRB was to ensure that the provisions of the Wagner Act were observed. One of the ways the Wagner did this was the establishment of unfair labor practices for management—things that management could not do—but it was silent about things that the union was not allowed to do. The Taft-Hartley Act was pro-management. It established unfair labor practices for the union, outlawed closed shops, and enabled states to pass “right-to-work” legislation, which had the effect of making the entire state an open shop state.
