Political and legal control over agency power resides in both the executive and legislative branches of government. Legal control includes Congress's ability to eliminate or reduce power or even abolish an agency by amending the enabling statute. Political control is also exercised through the budget process. An agency allocation in the yearly budget process has as much to do with what the agency can do as any formal control over the agency. Thus, the president, with an annual budget
request and Congress with appropriation legislation dramatically affect an agency's ability to perform. Judicial control is exercised by the independent review of agency action by the courts. A court may prevent or undo any unauthorized action by an agency; it may also compel agency action that has been unlawfully withheld.
