Entrapment is an improper or illegal inducement to crime by agents of law enforcement; also, a defense that may be raised when such inducements have occurred. Double jeopardy is a common-law and constitutional prohibition against a second trial for the same offense. In selective prosecution, the procedural defense of selective prosecution is based on the
Fourteenth Amendment's guarantee of "equal protection of the laws." This defense may be available where two or more individuals are suspected of criminal involvement, but not all are actively prosecuted. Prosecutorial misconduct consists of actions undertaken by prosecutors that give the government an unfair advantage or that prejudice the rights of a defendant or a witness. Denial of a speedy trial violates the Sixth Amendment. The purpose of guaranteeing a speedy trial is to prevent unconvicted and potentially innocent people from languishing in jail. The federal government and most states have laws (generally referred to as speedy trialacts) that define the time limit necessary for a trial to be "speedy." They generally set a reasonable period, such as 90 or 120 days following arrest. Collateral estoppel is similar to double jeopardy, but it applies to facts that have been determined by a "valid and final judgment." Such facts cannot become the object of new litigation.
