All client information, at least under the Model Rules, is protected, regardless of whether it is
private information and whether or not it relates to the client’s case. Here, the attorney
learned information that would help the welfare department in recovering a judgment it was
owed, and he was the attorney for the county welfare department. Although the attorney did
not intend on using the information against the mother (in fact, he did not sue her on behalf
of the department), the information was used against her by the father since, after he was
sued for the judgment, he brought her in as a co-defendant. It is important to note that the
attorney used this information without first getting the mother’s consent to use it.
