Students response should include (1.) the defendant must establish that the evidence was impermissibly suggestive by preponderance of the evidence; (2.) then the prosecution must demonstrate that the procedure is nonetheless reliable and the result can be trusted; (3.) then judge examines six factors (students can be expected to list the 6) to determine the reliability of the identification; and (4.) these factors are to be weighed against the fact that the witness may be influenced by the suggestiveness of the identification. Then the judge must rule whether the identification is admissible or inadmissible.
