Both the AIA and the EJCDC list specific events which will justify an owner’s
termination of the prime contract, including that the contractor failed to
supply adequate workers or materials, disregarded laws, or committed a
substantial breach of the contract documents. The AIA and EJCDC diverge at
points. The AIA adds as a ground for a default termination the contractor’s
failure to pay subcontractors, and the EJCDC includes repeated disregard of
the authority of the Engineer.
