If a suspect is arrested, booked, and charged, he or she will then be brought before a lower court judge for what is known as an initial appearance. Once a person is arrested, he or she must be brought before a magistrate "without unnecessary delay." The initial appearance, which is usually held within a few hours or, at most, a few days of arrest, serves to advise the suspect why he or she is being detained and to explain what the suspect's rights are. The judge will read the charges filed against the accused and will explain the penalties for each charge. The judge also will inform the suspect of the right to a trial by jury and the right to counsel, including the right to have an attorney appointed if the suspect is indigent.
