The Eighth Amendment prohibits cruel and unusual punishment. This protects the accused and convicted offenders from actions regarded as unacceptable by a civilized society, including corporal punishment and torture. Capital punishment has been a more controversial issue. Lethal injections are considered a way to avoid the "cruel" aspect of punishment. In Baze and Bowling v. Rees, the court upheld the use of lethal injection as a method of execution unless there is a "substantial risk of serious harm" that the drugs used will not work effectively. There have been various cases in recent years where lethal injection failed or seemed to cause the offender a great deal of pain.
