Truehe hearing begins with a benefit review conference, where the parties meets with a representative of the employer—or the employer’s workers’ compensation insurance provider—to discuss the issues raised by either the employer or employee. The purpose of the benefit review conference is to settle a benefit dispute without having to engage in a protracted hearing. If the case cannot be settled, then it goes to a hearing. Witnesses are called and evidence is offered to either prove or disprove the claim. At the conclusion of the hearing, it is the ALJ’s job to make findings of fact and rule in favor of one party.
