The design professional may be liable under the common law or under
statutory law. Under the common law, the worker claims the design
professional knew or should have known of a hazardous site condition, and
that the design professional owes construction workers a duty to act
reasonably to protect them from the hazard. The design professional would
likely not be found liable under the Occupational Safety and Health Act,
unless the design professional’s involvement on the project was inextricably
intertwined with the actual physical construction labor. Both AIA and EJCDC
contracts would not rise to that level of involvement.
