A commercial tenant’s bargaining power is considered to be on a more even footing with that of a landlord than is the bargaining power of a residential tenant; therefore, some state statutes allow more latitude for parties to negotiate their own terms in a commercial lease than would be allowed in a residential lease. For example, landlords may be permitted, by agreement, to allocate certain maintenance and repairs to the commercial tenant than would normally occur in residential leases. Additionally, indemnification provisions are found more often in commercial leases than in residential leases. Conversely, commercial landlords may provide more services for their tenants than are provided by residential landlords.
