Discuss the differences between an indictment and an information. What are the merits and downfalls of each? Which would you prefer if being charged in a criminal case? Why?
What will be an ideal response?
An indictment is a written accusation of a crime filed by the grand jury. An
information is a criminal charge filed by the prosecutor without the intervention of a
grand jury. A grand jury is intended to serve as a buffer or referee between the
government and the people who are charged with crimes. A grand jury meets in
secret and the defendant has no right to present evidence. Most states provide that
a prosecution by information may be commenced only after a preliminary
examination and commitment by a magistrate. I would prefer the information, as I
could have an attorney represent me and present evidence at a preliminary hearing.
