Sentencing—judge makes a determination or jury makes a recommendation. Some jurisdictions require judges to follow jury recommendations. Incarceration—most common formal sanction and the purpose is to confine the convict. Jail is a municipal facility for those sentenced to less than one year—prison is a state or federal facility for those sentenced to more than one year. Parole—early conditional release. Parole officers conduct surveillance and assist offenders in readjusting to the community.
