MR 5.4(a)(3) and DR 3-102(A)(3) provide an exception that allows lawyers or law firms to
include their nonlawyer employees in compensation or retirement programs. This type of
exception allows paralegals/legal assistants to be paid bonuses and to be included in
retirement compensation schemes.
In order for these types of compensation schemes to be considered legitimate, the money
given as bonuses needs to come from the firm’s general success (and not from a specific
case), or the money paid in to a 401(k) plan needs to come from net income (not gross
income).
