The Sixth Amendment provides defendants a number of rights, among which are: (1)
right to trial by jury, (2) right to counsel, (3) right to due process, (4) privilege against
self-incrimination, (5) right to a fair trial, (6) right to protection against double
jeopardy, (7) right to confront witnesses, (8) right to compulsory process to obtain
witnesses, (9) right to a speedy and public trial, and (10) right to proof of guilt beyond
a reasonable doubt. Most of these rights originate with either the Fifth, Sixth, or
Fourteenth Amendments. Proof beyond a reasonable doubt is the lone exception,
but has been inferred from the due process of the Fifth and Fourteenth
Amendments. Each right applies to the criminal justice process in a way to provide
the greatest opportunity for a fair trial and fair trial process.
