How does the "exigent circumstances" exception apply to pagers, other portable electronic devices, and computers?
What will be an ideal response?
Digital evidence is easily perishable. Basic computer commands can easily destroy data in a matter of seconds. Digital media can be altered or damaged by extreme temperature changes or magnetic fields. Exigent circumstances also apply to pagers because the information contained therein can be readily destroyed. Again, the case law regarding other handheld devices is in its infancy. If unsure, the best course of action is to seize, preserve, and obtain a warrant to search.
