Susan and Alex have been comfortably enjoying the split custody of their daughter, Marcy, for four years. Susan has Marcy for the school year in San Francisco, and Alex has the child for the summer in Los Angeles. However, Susan's job has changed, and she must travel extensively during the school year. She has reluctantly conceded that they will have to change the custody arrangement. What options are available for her to propose?

What will be an ideal response?

She might be able to switch the "split"-take Marcy for the summer. Much of their existing agreement would still work. Of course, Marcy would have to switch schools. Susan could consider requesting a modification to joint custody with Marcy living in LA and Susan having visitation rights-Alex would have the physical custody. This would result in increased visitation expenses, which courts will sometimes find not to be in the child's best interests, because it detracts from the amount available for support. Any modification would ideally be agreed on by the parents, but would still have to be presented to the court. The court would have to decide if the change is in the child's best interests.
