The ideal setup for an interview is an uncluttered conference room of appropriate
size. The conference room should be appropriately furnished with a comfortable
temperature. The room should be arranged so the paralegal and witness sits alongside each
other or at the corner of the table. Placing a table between the paralegal and witness creates a
physical barrier and classical posture of confrontation: eye-to-eye.
An uncontrolled environment is a place with distractions, such as telephones, computers, and
windows. The witness’s workplace can also be a distracting environment for a witness. If
the witness is at work, attempt to interview the witness at a break or lunchtime. If telephones
or computers are present, try to find a spot with fewer distractions so the witness can
concentrate on the paralegal’s questions.
