Monopolization involves having a monopoly plus showing a willful acquisition or maintenance of the power that goes beyond growth that results from superior product, business acumen, or historical accident. Monopolization is illegal while holding a monopoly is not. Not all monopolies can be stopped. For example, a small rural town may have only one gas station, giving the gas station some monopoly power. But, if the town is too small to support a second station, nothing can be done about the monopoly. Further, patents provide legal monopolies.
