Air rights may be classi?ed as public air rights that allow use for aerial transportation and communications technology, and private air rights owned by real property owners that extend from the surface of an allotted parcel of land up to a statutorily speci?ed height. Subsurface rights can be of considerable value should the subsurface contain hard minerals or oil and gas deposits.
