Discuss the important points with regards to cases that reach the Supreme Court for decision
What will be an ideal response?
1.There is no constitutional right to have the Court review a case.
2.The Court does not decide whether a person is guilty or not.
3.Almost everything the Court does is secret, except for the lawyers' arguments before the Court, the briefs they file, and the Court's published opinions.
4.Criminal cases come to the Court by way of two petitions. (They are called petitions because there is no right to the Court's review.) The petition for a writ of habeas corpus asks the Court to order some official (usually a prison warden or jail supervisor) to come to a trial court and justify a prisoner's imprisonment. The petition for a writ of certiorari asks the Court to order a lower court to send up the record of its proceedings for the Supreme Court to review. The Court issues the writ if four justices vote to issue it.
