The basic rights guaranteed during the trial process begin with the Sixth Amendment's protection of a speedy and public trial. The Sixth Amendment also guarantees the right to an impartial jury. The accused also has the right to be tried in the jurisdiction where the crime was committed. The accused must also be informed of the charges against her. In addition, the accused has the right is to be confronted with the witnesses against her so that she can prepare a proper defense.

One of the best-known rights of the accused is the right to counsel. For those who cannot afford an attorney, the state must provide one to them. The problem for indigent defendants is that you get what you pay for, and state-provided legal defense does not compare in quality or outcome to personal legal counsel.

Other rights of the accused include the Fifth Amendment's protection against double jeopardy, meaning that the defendant cannot be tried twice for the same crime if acquitted in the first trial. The defendant also cannot be compelled to testify against himself. Finally, the Supreme Court has determined that due process guarantees that evidence obtained in an illegal search and seizure cannot be used at trial.
