?Under a U.S. Supreme Court holding, the FHA does not now require proof of intentional conduct or disparate treatment. Now plaintiffs will be able to look at the statistical composition of areas and developments and determine whether there is sufficient representation of minority groups in the area. If those groups are not represented, then the developer would be liable for discrimination under the FHA. This finding would be true even though state and local housing authorities approved the developers for their projects. The result will be that developers will need to pick higher-priced areas in order to achieve integration and the result may be unaffordable housing for most minorities.
