The Health Information Technology for Economic and Clinical Health Act (HITECH ACT or "The Act") is an incentive program for medical practices related to the implementation of electronic medical recording systems. It contains specific incentives to speed up the installation of electronic health record (EHR) systems. Because this act will include a huge increase in the amount private healthcare information, the Act will increase security of this private health related information under HIPAA regulations. The Act will also make legal liability stronger. There will also be stricter enforcement of these laws. Under the Act, medical personnel will be legally required to inform patients of any breach in the privacy of their protected health information. If a breach occurs that effects more than 500 patients, then HHA will also be notified. It will also be required under various circumstances that local media be notified of the breech of health care information. It makes no different whether the unsecured breach occurred externally or internally, notification will still be required.
