Three types of solicitation are generally allowed. First, lawyers can solicit those with whom the lawyers have had a professional relationship. That includes present and former clients, as well as
family members. The Model Code also allows lawyers to solicit close friends. Second,
lawyers are also often allowed to solicit those that might become part of a class action. This
allowance has its origination in the Comments to MR 7.2, and in a U.S. Supreme Court case
that concerned solicitation for a federal class action suit. Not all jurisdictions, however, allow
for class action-solicitation. Third, lawyers may engage in not-for-profit solicitation. This
allowance comes from a U.S. Supreme Court case, In re Primus, in which the Supreme Court ruled that such solicitation is a form of political expression. An example of such would be
soliciting clients whose civil rights may have been violated.
