A Calvo clause, which is named for Carlos Calvo who was a 19th century Argentinean diplomat, is an exclusive jurisdiction clause that specifies that legal disputes will be litigated by the court of a host nation (Bondzi-Simpson, 1990). Calvo clauses were developed in 1927 by the United States-Mexican General Claims Commission and they stipulate that when a plaintiff has a legal claim they must first seek legal recourse in the local jurisdiction before they seek restitution for their claim in a foreign court (Stokes, 1978).
