Matson well known on the "street" was involved in the sale of heroin on a regular basis. One day a person unknown to him named Manny approached him and asked to purchase a substantial amount of heroin. At first Matson refused, but Manny insisted saying

he would pay whatever he (Matson) asked. After about one-half hour of pleading by Manny, Matson sold him a quantity of heroin. After the sale, Manny who was an undercover police officer arrested Matson. When brought to trial Matson's defense was entrapment because he was induced by Manny to commit this crime. Was this a good defense?


No. This was not entrapment. A review of page 57 in the text states that the key to entrapment is that the accused is a law abiding citizen who had no intention of committing the crime for which he/she was being accused. Matson was already a drug pusher. He as merely "set up" by Manny a police officer who used his position as a strategy to catch Matson.
