What will be an ideal response?
• A person asserting this defense must admit committing the offense and therein lies the primary risk factor. If the defense is rejected, a guilty verdict is all but guaranteed.
• The core issue is inducement. Was the accused an otherwise law-abiding citizen who was induced to commit a crime? Did law enforcement "manufacture" a crime that would not otherwise have been committed?
• Relevant considerations involve whether the accused was already involved in criminal activity, whether the police engaged in improper or criminal conduct offensive to our sense of justice, did law enforcement overcome the accused's initial refusals to commit the crime through threats, humanitarian appeals, temptation in the form of huge monetary gains, or persistent solicitation. Law enforcement's motivation may also be relevant if the concern was obtaining a conviction rather than preventing crime and protecting the public.
