Discuss the different approaches to privacy taken by the European Union and the United States.

The EU has a comprehensive suite of privacy laws based on the OECD Fair Information Practices, which applies to information both within the EU by enforcement and outside the EU by requiring would-be external data controllers to demonstrate their adherence to adequate similar laws before any information can be exchanged. The US, by contrast, has a flimsy and ad hoc ‘sectoral’ approach to privacy laws, regulating only certain industries and practices under specific individual legislation. This approach results in unclear privacy gaps, effectively placing much of the burden of privacy on individuals. In addition, and as with most everything in the United States, enforcement of existing laws is often lax. This difference is mostly due to the relatively higher influence of businesses and special interest lobbyists in American politics, as well as the general theme of reactionary rather than preventive legislation and policy.
