Certain conduct, whether it consists of an action or a failure to act, may be treated as negligence per se. This may occur if an individual violates a statute or an ordinance providing for a criminal penalty and that violation causes another to be injured. The injured person must prove (1) that the statute clearly sets out what standard of conduct is expected,(2) that he or she is in the class intended to be protected by the statute, and (3) that the statute was designed to prevent the type of injury that he or she suffered. The standard of conduct required by the statute is the duty that the defendant owes to the plaintiff, and a violation of the statute is the breach of that duty.?
