Answers should review both cases. In Furman, the Court found that the death penalty in Georgia did not provide any guidance to the sentencing body so that there was complete discretion in sentencing. As a result, the Court found that the death penalty was imposed in an extremely arbitrary manner, resulting in discrimination against minority offenders. The Court imposed a moratorium on the death penalty throughout the U.S. while states considered new legislation that would meet strict constitutional guidelines. Four years later, in Gregg, the Court lifted the moratorium and mandated a bifurcated trial in capital cases; the first part to determine the guilt or innocence of the accused and the second to determine the appropriate penalty.
